BrightBird Studio Terms of Service

1. Introduction Welcome to BrightBird Studio. By using our services, you agree to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern BrightBird Studio’s relationship with you in relation to this website and hosting service.

2. Services Provided BrightBird Studio offers website design, hosting, domain management, and maintenance services. Our standard package includes a professionally designed 5-page website, hosting, domain management, performance analytics, and weekly backups.

3. Client Responsibilities
Content Provision: Clients are responsible for providing accurate and complete content for their websites. Lorem Ipsum text will be used as placeholder content until the client provides the actual content.
Image Usage: Clients may use images from our demo sites, but it is recommended to use their own images to better represent their business.

4. Backup and Data Loss
Weekly Backups: We perform weekly backups of all client websites to ensure data safety.
Data Loss: While we take all necessary precautions to protect your data, BrightBird Studio is not responsible for data loss due to unforeseen circumstances, including but not limited to hacking, server failure, or data corruption. Clients are encouraged to maintain their own backups in addition to those provided by us.

5. Server Access and Management
No Server Access: Clients do not have direct server access. BrightBird Studio manages all technical aspects, including server maintenance and updates, to ensure optimal performance and security.
Domain Management: We handle all domain-related tasks, including registration, renewal, and DNS settings.

6. Email Hosting Services

We provide one professional email account as part of our hosting package. The following terms apply:

  • Service Availability: We strive to maintain continuous email service availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance.
  • Security: Clients are responsible for maintaining the security of their email accounts, including using strong passwords and enabling two-factor authentication where available.
  • Data Loss: While we perform regular backups of email data, BrightBird Studio is not liable for any loss of data. Clients are encouraged to maintain their own backups.
  • Compliance: Our email services comply with relevant data protection regulations. Clients are responsible for ensuring their use of email services complies with applicable laws.
  • Support: We provide support for email setup and basic troubleshooting. Extensive support requests may be subject to additional fees.
  • Appropriate Use: Clients must use email services appropriately and responsibly. Prohibited uses include, but are not limited to, sending spam, engaging in illegal activities, transmitting offensive or abusive content, and violating the rights of others. BrightBird Studio reserves the right to suspend or terminate email services for inappropriate use.

7. Payment Terms
Monthly Fees: The standard service fee is $49.95 per month, which includes all services outlined above.
Cancellation: Clients can cancel their service at any time without long-term commitments. Upon cancellation, clients will be responsible for any outstanding fees.

8. Limitation of Liability
Service Availability: While we strive to ensure uninterrupted service, we do not guarantee 100% uptime. BrightBird Studio is not liable for any loss or damage resulting from service interruptions.
Third-Party Services: Our services may include links to third-party websites or services. BrightBird Studio is not responsible for the content, privacy policies, or practices of any third-party websites or services.

9. Intellectual Property
Ownership: All content provided by the client remains the property of the client. Design and layout created by BrightBird Studio are proprietary and licensed to the client for use on their website.

10. Domain Ownership and Transfer
BrightBird Studio will register and manage the domain on behalf of the client as part of the service. The domain will remain under the control of BrightBird Studio until the client requests a transfer. If the client wishes to terminate the service and retain the domain, all outstanding fees must be settled before the domain transfer. Upon settlement of any dues, BrightBird Studio will transfer the domain to the client's chosen registrar account.

11. Amendments
BrightBird Studio reserves the right to modify these terms at any time. Clients will be notified of any changes, and continued use of our services constitutes acceptance of the modified terms.
